Warranty conditions
1. The company bellissa HAAS GmbH, Birkenstraße 22, D-88285 Bodnegg-Rotheidlen (hereafter: bellissa HAAS) guarantees the end customer (hereafter: customer) that, according to the following conditions, the products below sold to the customer will within a period of five years from their first sale to the end consumer (period of warranty) experience no rust and not rust through according to the following conditions.
2. The warranty will only become effective after online registration at www.bellissa.com/english/warranty within three months after the first purchase by the end consumer.
3. bellissa HAAS guarantees that the items described in more detail in Appendix 1 will be free of rust for five years after the invoice date of the end customer. This refers to damage to the surface caused by rust on steel (including visual damage). bellissa HAAS further guarantees that the Corten steel products listed in Appendix 2 will not rust through for a period of five years after the first sale to the end consumer. Rusting through in the sense of these warranty conditions is understood to refer to in-depth damage to the structure of the steel. With these products, a rust look on the surface is expressly desirable. bellissa HAAS guarantees that within the warranty period rusting through, that is to say damage to the structure, will not occur. All other products are excluded from the extended warranty. The definitive date for the beginning of the warranty period is the date of the original purchase receipt.
4. The warranty does not apply to spots of rust on the cut edges.
5. No claims exist under this warranty for
• Improper use due to chemical effects, particularly caused by aggressive liquids such as acid, fertiliser, sulphur, permanent contact with de-icing salt or permanently salt water
• Erosion of pyrite deposits with a large share of sulphur and iron content(e.g. greywacke)
• Destruction of the surface coating due to physical effects.
6. A precondition for claims made under this warranty is that the customer has registered the purchased product online within a period of 3 months after purchase at www.bellissa.com/english/warranty. After registration the customer will receive a confirmation of registration/certificate, which should be kept safely.
7. In the event of a warranty claim, the customer is to send the original purchase receipt and the confirmation of registration to bellissa HAAS, together with details of the claim and the corresponding photographs. The customer is responsible for any costs arising for sending in the product, together with the transport risks. The warranty service is limited to bellissa HAAS rectifying at its own cost the defect that is the subject of the claim with a follow-up delivery. Replaced parts become the property of bellissa HAAS. bellissa HAAS will not be responsible for costs of installation and removal, sending in of items, disposal costs and other time expenditure. All warranty claims can be registered at warranty@bellissa.com.
8. This warranty is limited to consumers normally resident in the European Union, Norway, Switzerland and the United Kingdom.
9. The contractual and legal rights of the customer with regard to bellissa HAAS (in particular defect-related rights as per §§ 437 ff. BGB (German Civil Code) are not affected by this warranty.
10. This warranty shall apply to the extent described above and under the conditions stated above to every future owner of the product.
11. This warranty is subject to the law of the Federal Republic of Germany, excluding conflict-of-law standards and excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory protective regulations of the law of the country in which the consumer customarily resides remain unaffected by this choice of law.
